1. About Mendez Painters

Mendez Painters Inc. is a Massachusetts painting and home-improvement company offering services that may include:

These Terms are not a construction contract, home-improvement contract, service contract, estimate, proposal, warranty agreement, financing agreement, or promise to perform work.

Any actual project or service will be governed by a separate written document, which may include:

  • An estimate;

  • A commercial-service agreement;

6. Free Estimates

A free estimate may not include:

An estimate may be based on:

  • Measurements taken during an inspection;

  • Information provided by the customer;

  • Photographs or videos;

  • Current material costs;

  • Expected labor requirements;

  • Reasonable assumptions about the condition of concealed areas; and

  • The scope requested at the time of the estimate.

An estimate may need to be revised if:

  • The customer changes the requested work;

  • Measurements or quantities change;

  • Material prices or availability change;

  • Concealed damage is discovered;

  • Structural, moisture, pest, rot, mold, lead, asbestos, electrical, plumbing, or other conditions are discovered;

  • The property is not reasonably accessible;

  • Additional preparation or repair is required;

  • Building officials require additional work;

  • The customer selects different materials or finishes; or

  • Circumstances outside our reasonable control affect the project.

No estimate becomes a binding contract unless it is accepted in the manner specified in the proposal or project agreement.

8. Estimate Validity

An estimate may be valid only for the period stated in the estimate.

If no validity period is stated, Mendez Painters may revise or withdraw the estimate before a contract is signed due to changes in:

  • Material costs;

  • Labor costs;

  • Market conditions;

  • Product availability;

  • Project scope;

  • Scheduling;

  • Property conditions; or

  • Applicable legal or permit requirements.

Submitting or receiving an estimate does not guarantee that the estimated price will remain available indefinitely.

9. Scheduling

Any date discussed before a contract is signed is tentative unless expressly confirmed in writing.

Project start dates and completion dates may be affected by:

  • Weather;

  • Rain, snow, wind, heat, humidity, or low temperatures;

  • Surface moisture;

  • Drying and curing requirements;

  • Material availability;

  • Supplier delays;

  • Permit or inspection delays;

  • Change orders;

  • Concealed property conditions;

  • Customer-requested changes;

  • Property-access limitations;

  • Employee or subcontractor availability;

  • Emergencies;

  • Utility interruptions;

  • Events outside our reasonable control; or

  • Other conditions affecting safe or proper performance.

Estimated project schedules are not guarantees unless expressly identified as guaranteed in a signed project contract.

10. Customer Responsibilities

For projects performed by Mendez Painters, the customer may be responsible for obligations described in the signed project agreement, including:

  • Providing timely and safe access to the property;

  • Providing accurate property and project information;

  • Identifying known hazards;

  • Identifying concealed utilities, pipes, wiring, irrigation, alarms, or similar systems;

  • Securing pets;

  • Supervising children and other occupants;

  • Moving furniture, decorations, vehicles, and personal property when required;

  • Removing fragile, valuable, or irreplaceable items;

  • Providing access to electricity and water when reasonably necessary;

  • Obtaining approvals from landlords, condominium associations, homeowners’ associations, lenders, or other parties;

  • Making agreed payments on time;

  • Selecting and approving colors, finishes, products, and materials;

  • Reviewing and approving change orders;

  • Maintaining reasonable indoor temperature and ventilation when necessary; and

  • Following project-specific preparation instructions.

Additional customer responsibilities may be included in the signed project contract.

11. Colors, Samples, and Product Appearance

Paint colors, tile colors, stains, finishes, coatings, photographs, computer screens, printed materials, and online color-selection tools may not perfectly represent the final appearance of a product or completed surface.

Actual appearance may vary because of:

  • Lighting;

  • Surface texture;

  • Existing coatings;

  • Primer color;

  • Number of coats;

  • Product sheen;

  • Application method;

  • Surrounding colors;

  • Screen settings;

  • Natural material variation;

  • Product batch differences; and

  • Weather or aging.

Customers are responsible for approving final colors, materials, products, and finishes before application or installation.

Once a customer approves a selection, changes may result in additional costs, delays, labor charges, or material charges.

12. Customer-Supplied Materials

If Mendez Painters agrees to use customer-supplied paint, fixtures, tiles, materials, coatings, or products:

  • The customer is responsible for purchasing the correct product and quantity;

  • The customer is responsible for the product’s quality and suitability;

  • Mendez Painters is not responsible for manufacturer defects;

  • Delays caused by missing or incorrect products may affect the project schedule;

  • Additional labor caused by unsuitable products may result in additional charges; and

  • Warranty coverage may be limited for customer-supplied materials.

The exact responsibilities concerning customer-supplied materials will be governed by the signed project contract.

13. Concealed and Unforeseen Conditions

Painting, repair, renovation, roofing, and remodeling work may reveal concealed or unforeseen conditions that could not reasonably be identified during the initial inspection.

These conditions may include:

  • Water damage;

  • Mold or mildew;

  • Rot;

  • Pest or insect damage;

  • Structural deterioration;

  • Improper previous repairs;

  • Loose or damaged plaster;

  • Failing drywall;

  • Defective siding;

  • Roof damage;

  • Damaged framing;

  • Electrical or plumbing problems;

  • Lead-based paint;

  • Asbestos-containing materials;

  • Hazardous substances;

  • Code violations; or

  • Other concealed defects.

Unless expressly included in the signed scope of work, correction of concealed or unforeseen conditions is not included in the original price.

We may pause affected work and provide recommendations, revised pricing, or a change order before proceeding.

14. Hazardous Materials

Unless expressly stated in a signed agreement, Mendez Painters is not being hired to inspect, test, remove, disturb, remediate, or dispose of hazardous materials.

Potential hazardous materials or conditions may include:

  • Lead-based paint;

  • Asbestos;

  • Mold;

  • Contaminated dust;

  • Chemical contamination;

  • Biological hazards;

  • Pest contamination;

  • Underground hazards; and

  • Other regulated materials.

If a suspected hazardous condition is discovered, work may be paused until the condition is evaluated or addressed by a properly qualified professional.

Nothing in these Terms limits any obligation imposed by applicable lead-safety, environmental, workplace-safety, or consumer-protection law.

15. Change Orders and Additional Work

Requests for work that is outside the agreed scope may require a written change order.

Additional work may include:

  • Repairs discovered after work begins;

  • Additional rooms or surfaces;

  • Additional coats;

  • Color changes;

  • Material upgrades;

  • Customer-requested design changes;

  • Work caused by another contractor;

  • Work required by inspectors;

  • Additional preparation;

  • Removal of unexpected coatings or materials; or

  • Rework caused by customer interference or damage.

Additional work may result in increased costs and an adjusted completion schedule.

The customer should not rely on an oral statement as approval of additional work when the signed contract requires a written change order.

16. Payments and Deposits

Prices, deposits, progress payments, final payments, accepted payment methods, late charges, and other financial terms will be stated in the applicable estimate or signed project contract.

Mendez Painters will follow applicable Massachusetts requirements regarding home-improvement contracts, deposits, and payment schedules.

Unless otherwise stated in a signed agreement:

  • A website inquiry does not require payment;

  • Submitting a form does not authorize a charge;

  • Payment is not considered complete until funds have cleared;

  • Returned or rejected payments may result in additional charges where legally permitted;

  • Failure to make a required payment may delay or suspend work; and

  • The customer remains responsible for approved work and materials provided.

Any fee, interest, collection cost, or late charge will apply only when authorized by the signed agreement and applicable law.

17. Cancellations and Rescheduling

Cancellation and rescheduling rules for estimates or projects may be stated in the applicable confirmation, proposal, or contract.

Customers should notify us as soon as possible when an appointment needs to be cancelled or rescheduled.

A signed home-improvement contract may include cancellation rights required by applicable law. Nothing in these Terms waives or limits a customer’s legally required cancellation rights.

Project-specific cancellation consequences, including responsibility for ordered materials, completed work, restocking fees, permit expenses, or nonrefundable third-party charges, will be governed by the signed project contract and applicable law.

18. Permits and Inspections

The signed project contract should identify which party is responsible for obtaining required permits and arranging inspections.

Permit requirements vary based on:

  • Municipality;

  • Property type;

  • Project scope;

  • Structural work;

  • Roofing work;

  • Electrical or plumbing work;

  • Historic-district rules;

  • Condominium requirements; and

  • Other applicable regulations.

No website statement should be interpreted as a representation that a permit is or is not required for a particular project.

19. Financing

The website may state that financing is available.

Financing, when offered, may be provided by an independent third-party lender or financing platform and may be subject to:

  • Application;

  • Credit approval;

20. Warranties

The website may advertise a two-year warranty or other satisfaction or workmanship commitment.

Any warranty applies only as described in the customer’s signed proposal, project contract, or separate written warranty document.

An advertised warranty does not automatically apply to every service, repair, material, or property condition.

Warranty coverage may depend on:

  • The specific service performed;

  • The product or material used;

  • The customer making all required payments;

  • Proper property maintenance;

  • Timely notice of a claimed issue;

  • Allowing Mendez Painters a reasonable opportunity to inspect;

  • Allowing Mendez Painters a reasonable opportunity to perform covered corrections; and

  • Compliance with the written warranty terms.

Unless the applicable written warranty states otherwise, warranty coverage may exclude issues caused by:

  • Normal wear and tear;

  • Building movement or settlement;

  • Water intrusion;

  • Roof or plumbing leaks;

  • Excessive moisture;

  • Mold or mildew;

  • Condensation;

  • Structural defects;

  • Substrate failure;

  • Rot;

  • Pest damage;

  • Previous defective work;

  • Customer-supplied products;

  • Manufacturer defects;

  • Damage caused by other contractors;

  • Impact, abuse, misuse, or neglect;

  • Failure to maintain the property;

  • Extreme weather;

  • Natural disasters;

  • Changes made after project completion; or

  • Conditions outside the work performed by Mendez Painters.

Manufacturer warranties, when available, are provided by the applicable manufacturer and are subject to the manufacturer’s terms.

Nothing in this section excludes warranties or remedies that cannot legally be excluded.

21. Satisfaction Statements

Statements such as “satisfaction guaranteed,” “we do it right the first time,” or similar language express our commitment to quality and customer service.

These statements do not create an unlimited refund right or permit a customer to withhold payment for completed conforming work.

Any specific correction, warranty, refund, or completion obligation will be determined by:

  • The signed project contract;

  • The approved scope of work;

  • The written warranty;

  • Applicable manufacturer instructions;

  • The condition of the property; and

  • Applicable law.

We encourage customers to communicate concerns promptly so that we have a reasonable opportunity to inspect and address them.

22. Before-and-After Photographs

Photographs displayed on the website are examples of previous work, design concepts, or representative results.

Every property and project is different. Photographs do not guarantee that another project will produce identical results.

Results may vary due to:

  • Existing surface conditions;

  • Property age;

  • Structural condition;

  • Customer selections;

  • Budget;

  • Materials;

  • Lighting;

  • Maintenance;

  • Weather;

  • Scope of work; and

  • Other project-specific circumstances.

23. Project Photography

We may take photographs or videos during an estimate or project for purposes such as:

  • Documenting property conditions;

  • Preparing an estimate;

  • Warranty administration;

  • Communicating with the customer;

  • Documenting concealed conditions;

  • Training;

  • Insurance;

  • Dispute resolution; or

  • Internal business records.

Public marketing use of identifiable project photographs will be handled in accordance with applicable permissions, the signed project contract, and our Privacy Policy.

24. Testimonials and Reviews

Testimonials and reviews reflect the experiences and opinions of the individuals who provided them.

Individual results and experiences may vary. A testimonial does not guarantee that every customer will have the same experience or result.

Mendez Painters does not prohibit customers from providing honest reviews or opinions about their experiences.

However, we reserve the right, where legally permitted, to report or request removal of content that:

  • Contains confidential or private information;

  • Is unrelated to our services;

  • Is fraudulent;

  • Impersonates another person;

  • Contains threats;

  • Is harassing or abusive;

  • Infringes intellectual-property rights;

  • Contains unlawful content; or

  • Is clearly false or misleading.

Nothing in these Terms restricts a customer’s right to provide an honest review as protected by applicable law.

25. Communications

By submitting a contact or estimate form, you authorize Mendez Painters to contact you about your request using the information you provide.

We may contact you by:

  • Telephone;

  • Email;

  • Text message; or

  • Other communication methods you request or authorize.

Your consent to be contacted about an inquiry does not automatically constitute consent to receive ongoing promotional text messages where separate consent is legally required.

You may unsubscribe from promotional emails through the instructions in the email.

Where applicable, you may reply STOP to stop promotional text messages and HELP for assistance. Message and data rates may apply.

We may continue sending non-promotional communications related to an active estimate, appointment, project, payment, warranty request, legal matter, or customer-service issue.

26. Accuracy of Submitted Information

You agree to provide accurate, current, and complete information when submitting a form or communicating with us.

You may not:

  • Impersonate another person;
